1. About these Terms

These Terms of Service (“Terms”) govern your access to and use of the Tetherwallex website and services (the “Service”), operated by Tetherwallex (“we”, “us”, “our”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, you must not use the Service.

We may update these Terms from time to time (see “Changes” below). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. You may not use the Service if you are located in, or are a resident or national of, any jurisdiction where the use of the Service or of the connected exchanges is prohibited, or where you are subject to applicable sanctions. You are responsible for ensuring that your use of the Service is lawful in your jurisdiction.

3. What the Service is (and is not)

Tetherwallex is an independent referral and information platform. We help you sign up to third-party cryptocurrency exchanges through our referral links so that the exchange returns part of your trading fees to you (“cashback”/“payback”). For some exchanges, the cashback is credited by the exchange directly to your exchange account; we do not hold, custody, or transmit those funds.

We are not a cryptocurrency exchange, broker, wallet, money services business, or financial adviser. Nothing on the Service constitutes financial, investment, legal, or tax advice. All trading and investment decisions are your own.

4. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information, including a valid exchange UID that belongs to you. You must not impersonate any person, use another person’s information, or attempt to obtain cashback by fraudulent or improper means. We may suspend, restrict, or reverse cashback, and suspend or close accounts, where we reasonably suspect a breach of these Terms.

5. Referrals and cashback

Cashback rates, eligibility, settlement, and payout methods are determined by the relevant exchange and are subject to that exchange’s own terms and conditions, which apply to your relationship with the exchange. Rates and programmes may change or be discontinued at any time, including by the exchange. We do not guarantee any particular cashback amount, and figures shown by our calculators are estimates only.

We may receive a commission from exchanges in connection with referrals. Cashback generally applies only to accounts newly created through our referral link; exchanges typically do not apply referral cashback retroactively to pre-existing accounts.

6. Community and acceptable use

You agree not to use the Service to post or transmit content that is unlawful, defamatory, fraudulent, abusive, infringing, or spam; to attempt to gain unauthorised access; to interfere with the Service; or to use automated means to access it without our permission. You are solely responsible for content you submit. We may remove content and restrict accounts that breach these rules.

7. Risk warning

Cryptocurrency trading involves significant risk, including the risk of losing some or all of your capital. Prices are volatile and past performance is not indicative of future results. You should only trade with funds you can afford to lose and seek independent advice where appropriate.

8. Intellectual property

The Service, including its design, text, graphics, logos, and software, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works without our prior written consent.

9. Third-party services and links

The Service contains links to third-party exchanges and websites. We do not control and are not responsible for the content, products, services, or practices of those third parties. Your use of any third-party service is governed by that party’s own terms and policies.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties, express or implied, regarding the Service, including as to availability, accuracy, or fitness for a particular purpose. We do not warrant that the Service will be uninterrupted or error-free.

11. Limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. If you are a consumer, your statutory rights under the Consumer Rights Act 2015 and other applicable UK law are not affected by these Terms.

Subject to the above, we are not liable for any loss of profits, trading losses, loss of cryptocurrency or funds, loss of data, or any indirect or consequential loss arising out of or in connection with your use of the Service or any connected exchange.

12. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, and reasonable costs (including legal fees) arising from your breach of these Terms or your misuse of the Service, except to the extent caused by our own breach or negligence.

13. Suspension and termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or where reasonably necessary to protect the Service or other users. You may stop using the Service at any time.

14. Changes to the Service and Terms

We may modify or discontinue all or part of the Service, and may amend these Terms, at any time. Where changes are material we will take reasonable steps to notify you, for example by posting an updated version with a new “Last updated” date.

15. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your home jurisdiction.
